Article 1: Terms & conditions

The e-commerce site La Buena Vida, [scrl] whose head office is located at 2360 Oud-Turnhout, Steenweg op Mol 205, BTW BE0453.270.805, enables its customers to buy its products on-line.

These Terms & Conditions apply for any order placed by a visitor on this site (hereafter named the Customer). Placing an order via the e-commerce site of La Buena Vida implies that the Customer has read these Conditions and accepts them explicitly, excluding any other terms & conditions which have not been explicitly approved in writing beforehand by La Buena Vida.

Article 2: Pricing

All quoted prices are in EURO, including VAT, tax and duties to be paid by the Customer.

If delivery, reservation or administrative costs are charged, they will be mentioned separately.

The indication of price only refers to the article as it is described verbally. The accompanying photos are designed for decoration and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website are compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind La Buena Vida. La Buena Vida is only bound to an obligation of means for the correctness and completeness of the information provided. La Buena Vida is in no way liable in the event of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about size, color, availability, delivery terms or delivery methods, for instance, we request the Customer to contact our customer service in advance.

The offer is valid as long as stocks last and can be adjusted or withdrawn at any time by La Buena Vida. La Buena Vida cannot be held responsible for the unavailability of a product.

Article 4: On-line purchase

Products can be ordered via After payment, these will be delivered at home by our own logistic services, or via the Sending Wines service.The Customer can choose between the following payment methods:
  • Cash on collection of the goods
  • Via bank draft / transfer
  • Via Visa / Mastercard credit card
  • Via Bancontact / Mister Cash
  • Via iDeal
  • Via Paypal

The offer of the goods is subject to the acceptance of the order by La Buena Vida. La Buena Vida reserves the right to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.

Article 5(a): Delivery and execution of the agreement

Items ordered through this webshop can be delivered in Belgium, the Netherlands and Germany.

The delivery is made by our own transport services or via the Sending Wines services.

Unless other agreement is made or expressly stated, the goods are delivered to the Customer within 30 days of the order receipt. La Buena Vida reserves the right not to deliver goods to minors.

Any visible damage and/or qualitative deficiency of an article or other defect in the delivery must be immediately reported to La Buena Vida.

The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, which is not the carrier) has received the goods physically. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier of the Customer has been instructed to transport the goods and this choice was not offered by La Buena Vida.

Article 8: Warranty

Pursuant to the law of 21 September 2004 concerning the protection of consumers in the sale of consumer goods, the consumer has statutory rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty leaves these rights unabated.

La Buena Vida will replace any bottle of cork-tainted wine. The Customer will return at his or her expense the opened bottle with its cork to La Buena Vida, which will then provide a replacement bottle (although it may not be the same vintage). In order to make use of the guarantee, the Customer must be able to present a proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact the La Buena Vida customer service before returning the item at the Customer’s expense.

When noticing a defect, the Customer must inform La Buena Vida as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months. Afterwards, the right to repair or replacement lapses.

The (commercial and/or legal) warranty is never applicable to defects arising as a result of accidents, neglect, falls, use of the article in violation of the purpose for which it was designed, non-compliance with the instructions for use or instructions, modifications or changes to the article, crackdown, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, or delivery if applicable, are deemed to be no hidden defects, unless the Customer proves otherwise.

The warranty is not transferrable.

Article 13: Validity

If any provision of these terms and conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

Any failure by La Buena Vida to enforce any of the rights listed in these Terms and Conditions, or any right to exercise them, shall never be regarded as a waiver of such provision and shall never affect the validity of these rights.

Article 14: Change of conditions

These Terms and Conditions are supplemented by other conditions that are explicitly referred to and the general sales conditions of La Buena Vida. In case of contradiction, these Terms and Conditions will prevail. La Buena Vida may change these Terms & Conditions without prior notice. Any purchase made after such a change implies the Customer has approved the new Terms & Conditions.

Article 15: Means of proof

The Customer accepts that electronic communications and backups can serve as proof.

Article 16: Law & Jurisdiction

Belgian law applies, with the exception of the provisions of private international law on applicable law and with the exception of the Rome I Convention on international purchase agreements concerning movable property. The courts of Turnhout shall have the sole jurisdiction and venue for any litigation.
